Working in Azerbaijan as a French National: Work Permit, Salaries, Tax and Social Protection
Key points
A French employee in Azerbaijan needs a work permit issued by the State Migration Service at the employer's request: it is valid for one year at most, extendable by one year each time, and comes with a temporary residence permit. Several categories are exempt from a permit, notably entrepreneurs, permanent residence permit holders and spouses of Azerbaijani citizens. The State Tax Service indicates that monthly salaries up to AZN 8,000 in the non-oil private sector have been exempt from income tax since 2019, for a period of seven years. A Franco-Azerbaijani tax agreement has been in force since 1 October 2005, but no social security agreement links the two countries.
- Work permit: one year initially, extension of one year at most each time, filed by the employer at least 30 days before expiry (State Migration Service).
- Average nominal monthly wage published by the State Statistics Committee; the Central Bank rate makes it possible to convert it into euros.
- Income tax: temporary exemption (seven years) of monthly salaries up to a ceiling in the non-oil private sector; duration and ceiling to be checked with the State Tax Service.
- France-Azerbaijan tax agreement: signed on 20 December 2001, in force since 1 October 2005, applicable to income of 2006 (BOFiP).
- Secondment outside an agreement: 3 years, renewable once, with care reimbursed within the limit of French tariffs (CLEISS, the French centre for European and international social security liaison).
- After a refusal of the work permit or its expiry with no other ground of stay, the worker must leave the country within 10 working days (State Migration Service).

Right to Work and Work Permit for a French National
A French national has no automatic right to work in Azerbaijan: employment requires a work permit, issued by the State Migration Service. The application is filed by the employer. The service specifies that the worker must be fit for work and over 18, that the position must not have been applied for by a qualified Azerbaijani candidate, and that the employment services must not be able to meet the need with local labour. The employer employs a foreigner only at their own place of work, under a contract whose duration matches that of the permit; hiring without a permit is prohibited.
The file includes the form, the passport copy, notarised proof of qualifications, proof of the need to employ the worker, the company’s documents (articles and registration certificates, or identity document and tax certificate for an individual) and a certificate establishing the absence of a dangerous infectious disease on the official list. The permit is issued only after payment of State fees, the amount of which falls under the law on State fees and does not appear on the service’s page.
Duration, Renewal and Exemption Cases
The work permit is issued for one year; if the contract is shorter, the permit follows the contract’s duration. Each extension may be up to one year (two years for workers in the liberated territories), to be requested by the employer at least 30 days before expiry. The permit is withdrawn if extension fees are not paid within 30 days or if the temporary residence permit is refused; with no other ground of stay, the worker then leaves the country within 10 working days. A temporary residence permit accompanies the work permit, for one year at most and renewable.
The service lists nearly two dozen categories exempt from a work permit. They include permanent residence permit holders, entrepreneurs carrying out business in Azerbaijan, diplomatic and consular staff, employees of international organisations, professors invited by universities, heads of registered foreign branches, people married to an Azerbaijani citizen registered at their address and highly qualified migrants working in their speciality. The individual situation should be confirmed with the service, which can be reached on +994 12 565 61 18 or by email at info@migration.gov.az. For entry and residence formalities, see the page living in Azerbaijan.
Salaries and Minimum Wage
The State Statistics Committee publishes the average nominal monthly wage. This average covers the whole economy; pay offered to foreign managers varies by sector, position and the contract currency. The table of minimum wages published by the State Statistics Committee refers to an official scale whose amount in force should be confirmed with the Ministry of Labour and Social Protection of the Population; it is therefore not reproduced here.
The State Tax Service recalls the rights of the employee under contract: minimum wage protection, paid leave, compensation at the end of a fixed-term contract, limits on dismissal at retirement age, and online signing of the employment contract. The absence of a written contract exposes the employee as well as the employer, hence the value of requiring a declared contract before starting the job.
Income Tax and the Franco-Azerbaijani Tax Agreement
The State Tax Service indicates that, since the 2019 reform, monthly salaries up to AZN 8,000 in the non-oil private sector are exempt from income tax for seven years. The regime applicable at the end of this period should be checked on the State Tax Service website or at the call centre 195-1. The same service publishes monthly reductions of the taxable base, from AZN 800 to 50, for specific categories (article 102 of the Tax Code), which do not concern the ordinary employee. The scale applicable to salaries in the oil and public sectors and to income above the exemption ceiling is read in the Tax Code.
The tax agreement between France and Azerbaijan was signed in Paris on 20 December 2001. It was published by decree no. 2005-1294 of 13 October 2005 (Official Journal of 21 October 2005), in force since 1 October 2005 and applicable to income from 2006; it covers income tax and wealth tax, and replaces the 1985 agreement with the former USSR (BOFiP). The state where a salary is taxed depends on tax residence and the rules of the article on employment income, whose text is read in the published decree; the BOFiP commentary consulted does not reproduce these articles. French tax residents declare their worldwide income on impots.gouv.fr, with the credits provided for by the agreement.
Social Protection of the Local Employee and the Seconded Employee
CLEISS does not list Azerbaijan among the states linked to France by a social security agreement. An employee sent by a French employer may remain affiliated to the French scheme through the secondment provided for by French law: duration of “3 years renewable once”, contributions paid in France as if the activity were carried out there, and care reimbursed within the limit of French benefits on paid invoices and form S 3125c. CLEISS specifies that contributions may also be due in the country of secondment. See the glossary entry on the seconded employee and the guide seconded or expatriate.
An employee on a local contract comes under the Azerbaijani scheme. The State Agency for Compulsory Health Insurance (DTSEA) specifies that foreigners holding a temporary or permanent residence permit are insured when they pay the compulsory contribution; the rates do not appear on the page consulted and should be confirmed with the agency (call centre 1542) and the employer. The local employee’s rights are described in the page healthcare system in Azerbaijan, and the glossary entry on the local contract helps distinguish the statuses.
Self-Employed, Entrepreneurs and Remote Work
Entrepreneurship is among the grounds for a temporary residence permit: the management or deputy management of a branch or representative office of a foreign company, the management of a local company founded by a foreigner or at least 51% owned by a foreign party, or activity as an entrepreneur. Entrepreneurs carrying out business in Azerbaijan are also exempt from a work permit. The turnover thresholds used for certain grounds are set by the Ministry of Economy and do not appear on the migration service’s page.
The official sources consulted describe no specific status for foreign remote workers or digital nomads. An employee of a French company who works remotely from Azerbaijan settles their residence, social situation and taxation before departure with the State Migration Service, the Urssaf (the French social contributions collector), CLEISS and the French tax administration. See also digital nomad insurance.
The Azerbaijani Economy in Perspective
The “Economic indicators” block above displays continuously updated indicators. The State Statistics Committee publishes the change in GDP and consumer prices. The currency is the manat (AZN), whose daily rate is published by the Central Bank. The committee’s statistics serve as a benchmark for placing a job offer against the national average.
Before signing, a candidate compares the pay in foreign currency, the length of the permit, their family’s health and repatriation cover, as well as the recommendations of France Diplomatie (the French foreign ministry), which advises against travel except for compelling reasons.
